UNDERSTANDING THE EXPLORATION PERMIT (PR) IN THE DRC

I. Definition

It’s essential to note that conducting mining activities in the Democratic Republic of the Congo requires specific legal titles, such as the Research Permit, which this legal brief will explain in simple terms.

The Research Permit (PR) is an official, exclusive title issued by the DRC Ministry of Mines through the Cadastre Minier (CAMI) that authorizes prospecting for mineral resources within a designated area. Application for the PR requires a physical submission in triplicate to either the CAMI central office in Kinshasa or the relevant provincial division based on the project's location.

It is critical to note that the application submitted to CAMI must pertain to an available perimeter, meaning it must be free of any other mining rights, and the applicant must be the first to claim it.

The applicant must demonstrate financial capacity, ensure all administrative documentation is in order, and possess the required technical competence by engaging industry professionals such as geologists and legal counsel. Furthermore, the applicant must settle the file processing fees and annual surface rights, as well as secure a Mitigation and Rehabilitation Plan (PAR) duly approved by the Directorate for the Protection of the Mining Environment (DPEM). This approval is contingent upon establishing a financial guarantee for rehabilitation, committing to proper water and waste management, respecting local communities, and consenting to regular audits by environmental inspectors tasked with ensuring compliance with the PAR.

II. Operating Mechanisms

The permit grants absolute exclusivity, ensuring that no party other than the holder is authorized to conduct exploration activities within the designated perimeter. It is critical to emphasize that it does not confer any commercial sale rights. While this permit authorizes the extraction of samples for laboratory analysis, it strictly prohibits the sale of minerals on a commercial scale.

It does, however, confer a Priority Right of Exploitation, meaning that if the holder discovers a viable deposit, the PR grants them the preferential right to obtain an Exploitation Permit (PE)—which we will analyze next week—to transform exploration into an active mining operation.

III. Term of Validity

The initial duration is 5 years, renewable only once for an additional 5 years period (subject to the evaluation of the work performed).

This initial mining title constitutes the essential prerequisite enabling the economic operator to assess the feasibility and profitability of a future exploitation within the conceded perimeter.
